Lawsuits

BELLEVILLE — BNSF Railway is accused of negligence after a former employee claims he suffered severe injuries to his face.

Bennie Graham filed a complaint  Dec. 10 in the St. Clair County Circuit Court against BNSF Railway Company, alleging negligence.

According to the complaint, Graham was a "maintenance of way" worker for BNSF. He alleges that on Dec. 20, 2017, he was working near Dundee, Mo., and was "manually removing a metal clip" that secures a railroad tie when he was "severely and permanently" injured.

Graham claims he suffered injuries to his face, which has caused him "great pain and mental anguish" and disability. He also claims he suffered loss of income and has incurred medical expenses due to his injuries.

Graham alleges in his complaint that BNSF is negligent because it failed to provide "safe and suitable" equipment for him to perform his job duties, failed to warn of the hazard that existed and allowed "unsafe work practices."

Graham seeks compensation of more than $50,000 and all other just relief. He is represented by John Papa of Pratt & Tobin PC in East Alton.
