A tractor-trailer driver and his passenger claim they were injured when another truck driver allegedly caused a rear-end collision due to traffic caused by road construction.
Edgar Ramos and Derek Ramos filed the complaint Dec. 9 in the U.S. District Court for the Southern District of Illinois against Araya Trucking LLC and Tesfemikael Tesfaldet Araya.
According to the complaint, Edgar Ramos was driving a 2006 freightliner tractor-trailer on July 13 at approximately 3:14 p.m. Edgar Ramos was traveling eastbound in the right lane on I-70 near milepost 110 in Cumberland County. Derek Ramos was riding as a passenger in the tractor-trailer operated by his father. At the same time, Araya was operating a 2006 freightliner tractor-trailer at the same time and place, acting within the scope of his employment with Araya Trucking.
The plaintiffs claim they were stopped in traffic waiting to merge into the left lane due to construction in the right lane when Araya rear-ended the plaintiff’s tractor-trailer.
Araya is accused of negligently failing to reduce speed to avoid a collision, driving his vehicle too fast for conditions, following another vehicle too closely and failing to keep a proper look-out for other vehicles.
As a result, the plaintiffs claim they suffered injuries “of a personal and pecuniary nature.”
Edgar and Derek Ramos seek an unspecified judgment in their favor. They are represented by Michael Gill of Pfaff Gill & Ports Ltd. in Chicago.
