Shopper sues Kroger after allegedly tripping in parking lot

A woman claims she was injured when she tripped on a broken sign in a Kroger parking lot, causing injuries. 

Lucille Clark filed the complaint on Dec. 14 in the U.S. District Court for the Southern District of Illinois against Kroger Ltd. Partnership. 

According to the complaint, Clark was a customer at a Kroger grocery store in Anna on June 6. She claims that while she was walking in the parking lot to enter the store, she tripped on the base of a sign post that had previously broken, causing her to fall to the ground. 

As a result, Clark claims she suffered serious injuries to both arms including a comminuted fracture of her right distal radius. 

Clark alleges the broken sign base was not marked with warnings or barricades when Clark tripped. She alleges it was dark in color, blending in with the parking lot surface. 

Kroger is accused of negligently failing to properly maintain the parking lot, failing to promptly address a hazard which it knew or should have known existed, failing to barricade the hazard, failing to mark the hazard, and failing to replace or repair the sign. 

The plaintiff seeks a judgment in her favor in excess of $50,000, plus court costs. She is represented by Bruce Cook of Cook Bartholomew Shevlin Cook & Jones LLP in Belleville.
