EDWARDSVILLE — A man injured in a collision claims his insurance carrier acted in bad faith by failing to timely approve his underinsured motorist claim.
Douglas Wojcieszak filed a complaint Dec. 1 in the Madison County Circuit Court against Automobile Club Inter-Insurance Exchange, alleging breach of contract and bad faith.
According to the complaint, Wojcieszak, who holds an automobile insurance policy with Automobile Club Inter-Insurance Exchange, alleges he was injured in a car crash with a third party on July 25, 2015. He alleges his policy included underinsured motorist coverage for bodily injury of up to $250,000.
He claims he suffered "damages and injuries" of more than $50,000 including medical bills of more than $26,000 as a result of the collision. Wojcieszak further alleges he settled the third party case for the third party's "fully policy limits of $50,000" with the approval of the defendant. He claims he is entitled to $200,000 "in underinsured benefits" according to his policy. He also claims Automobile Club Inter-Insurance Exchange failed to make a "good faith effort" to "effectuate a prompt, fair and reasonable settlement." He also claims the insurance carrier "made no offer whatsoever" and claimed he was "fully compensated for his injuries."
Wojcieszak seeks monetary relief of more than $50,000 and all other proper relief.
