Former corrections officer alleges insurer wrongfully terminated disability benefits

EDWARDSVILLE — An insurance carrier is accused of wrongfully terminated the long term disability benefits of a former Missouri corrections officer with Multiple Sclerosis. 

Rubeno Curtis filed a complaint Nov. 19 in the Madison County Circuit Court against The Standard Insurance Company, alleging breach of contract. 

According to the complaint, Curtis began working as a full time employee for the State of Missouri on Feb. 14, 1996. He later became disabled due to Multiple Sclerosis on March 7, 2016 while working as a corrections officer. 

Curtis claims that he was a participant in a group long term disability insurance policy through the Trustees of the Missouri Employees Retirement System (MOSERS). He alleges in his complaint that he filed a disability claim in March 2016, which was approved by Standard Insurance Company on April 29, 2016. Curtis allegedly received long term disability benefits for three years until they were terminated on Nov. 24, 2019. 

The suit states that Standard Insurance Company said Curtis exceeded his "work earnings" while working as a driver for foster children. He alleges Standard incorrectly calculated his income by including his "mileage reimbursement as 'work earnings.'"

Curtis seeks monetary relief, trial by jury and all other just relief. He is represented by Attorneys Matthew Davis and Gallagher Davis in St. Lois.
