Man sues insurance carrier over alleged failure to pay claim despite arbitration ruling

EDWARDSVILLE — A man who claims he was injured in a car crash alleges his insurance carrier has failed to pay the underinsured motorist coverage under his policy, despite an arbitration ruling in his favor. 

Weston Cooper filed a complaint Nov. 18 in the Madison County Circuit Court against Country Mutual Insurance Company, alleging breach of contract. 

According to his complaint, Cooper is insured with an automobile policy through Country Mutual Insurance, which includes underinsured motorist coverage and medical payments.  He alleges that on July 26, 2013, he suffered "severe" injuries in a car crash and immediately filed a claim for underinsured motorist coverage under his policy. Cooper claims in his suit that Country Mutual Insurance authorized him to "accept the tortfeasor's combined liability polices," which reduced Country Mutual Insurance's "underinsured motorist exposure" for his claim. 

He further claims Country Mutual Insurance has failed to pay his medical expenses even though the insurance company's "medical expert" associated his injuries with the July 2013 car crash. Cooper states in his suit that despite an arbitration award he received on Oct. 24, Country Mutual is contesting the extent and cause of his medical issues. 

Cooper seeks monetary relief of more than $50,000 and all other proper relief. He is represented by Rodney Caffey of The Caffey Law Firm LLC in Godfrey.
