Suit alleges Metro driver caused collision on Poplar Street Bridge

BELLEVILLE — A woman claims a Metro driver's negligence caused her to suffer injuries when her vehicle was side swiped on the Popular Street Bridge near the Missouri line.

Angela Garth filed a complaint  Nov. 10 in the St. Clair County Circuit Court against The Bi-State Development Agency of the Missouri-Illinois Metropolitan District, doing business as Bi-State Development Agency, doing business as Metro. The suit alleges vicarious liability and negligence. 

According to the complaint, Garth was a passenger in a car driven by her sister. They were traveling on the Popular Street Bridge just east of the Missouri line on Dec. 7, 2018. Garth alleges that Cross, an employee of Metro, was driving one of Metro's vehicles in the lane next them on the bridge. Garth claims Cross changed lanes and side swiped the rear driver passenger corner of the vehicle she was traveling in and caused her to suffer injuries to her head, shoulder, neck and right knee. Garth also claims Cross was driving at "an excessive rate of speed," failed to keep a proper lookout and failed to properly change lanes. She also alleges Cross had "ample time and opportunity to avoid" the collision.

Garth seeks monetary relief of more than $50,000 and all other proper relief. She is represented by George Albers of Butler and Kempler Law in Granite City.
