Two St. Clair County nursing homes accused of negligent care

BELLEVILLE — Two St. Clair County nursing and rehabilitation facilities are being sued by the estate of a former resident alleging they contributed to her physical, mental deterioration and death. 

Kimmy Taake, as independent administrator for the Estate of Linda Utley, filed a complaint Nov 5 in the St. Clair County Circuit Court against Memorial Regional Health Services Inc., doing business as Memorial Care Center, and Caseyville Nursing and Rehabilitation Center Inc, alleging negligence and wrongful death. 

According to the complaint, Utley was admitted to Memorial Care Center in St. Clair County on Dec. 21, 2018, after undergoing hip surgery.  Taake alleges in the suit that while at the facility, Utley did not receive the necessary care and services she required. As a result of the defendants' alleged negligence, Utley suffered "marked deterioration" and disability.

Taake claims Utley developed pressure sores, ulcers and other related conditions. She specifically alleges that on Jan. 15, 2019, Utley developed a pressure ulcer on her buttuck/tailbone and that on Jan. 20, 2019, Utley developed ulcers on her heel before being transferred to Caseyville Nursing and Rehabilitation Center on Feb. 5, 2019. 

Taake claims that while she was at Caseyville Nursing and Rehabilitation Center, Utley's pressure ulcers worsened. Utley was discharged from Caseyville on March 30, 2019, and died on April 14, 2019. 

Taake seeks compensation of more than $50,000 and all other proper relief. She is represented by Robert Marcus of The Gori Law Firm PC in Edwardsville.
