Woman sues over icy slip, fall while pumping gas

EDWARDSVILLE — A woman claims she slipped on ice and snow while pumping gas at a general store, suffering injuries to her leg. 

Elizabeth McMahan-Asbury filed a complaint Nov. 9 in the Madison County Circuit Court against Casey's General Stores Inc., doing business as Casey's General Store #2332, alleging negligence. 

McMahan-Asbury alleges in her complaint that she was pumping gas at Casey's General Store on Washington Avenue in Alton on Nov 15, 2018. While pumping gas, she claims she slipped and fell on "snow and/or ice" that had accumulated near one of the gas pumps. 

As a result, McMahan-Asbury claims she suffered "severe and permanent" injuries to her right leg and has suffered "great pain" and mental anguish. She also claims she has incurred medical expenses. 

McMahan-Asbury alleges "an agent or employee" of Casey's attempted to clear out the snow and ice that had accumulated in the area prior to her pumping gas. She alleges Casey's negligently failed to maintain the area around the gas pumps and failed to prevent the accumulation of the ice and snow that caused a "slick condition." She also alleges the defendants failed to warn or "cordon off" the "slip hazard" area around the pumps. 

The plaintiff seeks compensation between $50,000 and $75,000, plus court costs and all other just relief. She is represented by Mary Massa and Todd Schroader of Becker, Schroader & Champan PC in Granite City.
