Woman alleges piece from construction company's sign caused her fall on public sidewalk

BELLEVILLE — A pedestrian is suing a construction company after she allegedly fell after tripping on a wooden piece from an advertising sign that had been extended onto the sidewalk. 

Carol Bostick filed a complaint Oct. 29 in the St. Clair County Circuit Court against Middendorf & Reuss Construction, alleging negligence. 

According to the complaint, Bostick was walking on a public sidewalk at nightfall at the intersection of West Mill Street and North Monroe Street in St. Clair County on June 8, 2019. Bostick alleges that while walking on the sidewalk, which "abutted the parking lot" of the Millstadt Community Consolidated School, she tripped over a wooden board that had been placed on the sidewalk. 

Bostick claims that the wooden board was used by the defendants to secure their advertisement sign and was extended from their sign onto the public sidewalk. 

As a result of her fall, the plaintiff claims she suffered injuries to her face, head, neck, back, hips, right arm and hand. 

Bostick alleges that the defendants "failed to take adequate measures" to insure the board did not "make the sidewalk dangerous for lawful pedestrians." She also claims the defendants created an unsafe condition that interferes "with the customary and regular use of the sidewalk."  

Bostick seeks compensation of more than $50,000 and all other proper relief. She is represented by John Wilbers of The Wilbers Law Firm LLC in St. Louis, Missouri.
