Great Clips salon franchises sue insurance carrier over denied pandemic business loss claim

EDWARDSVILLE — The owners and operators of Great Clips franchises in Colorado and Missouri are suing their insurance carrier for allegedly denying COVID-19 business interruption claims. 

Holtzman Enterprises Inc., on behalf of itself and all others similarly situated, filed a complaint Nov. 4 in the Third Judicial Circuit for Madison County against CNA Financial Corporation, alleging breach of contract, breach of covenant of good faith and fair dealing and breach of Colorado's Consumer Protection Act.

According to the complaint, the plaintiffs allege they purchased a commercial insurance policy from CNA for a period covering Feb. 11, 2020 through Feb. 11, 2021. They allege their policies "promise to indemnify the policyholder" for business losses incurred if their "business operations are involuntarily suspended, interrupted or curtailed" due to physical loss or damage to their property. 

The plaintiffs claim they suffered losses and expenses due to the closure of their hair salons during the states' stay-at-home orders in March because of the COVID-9 pandemic. The plaintiffs specifically claim that their polices cover "loss of or damage to property" and that they suffered "loss of their property" by not being able to access businesses to operate their salons. 

The plaintiffs seek compensation and all other just relief.
