Fed-Ex subcontractor allegedly tripped over boxes at warehouse, suffered injuries

BELLEVILLE — A truck driver claims he was injured when he tripped over boxes left scattered by Fed-Ex employees. 

Matthew Gardner filed a complaint Oct. 21 in the St. Clair County Circuit Court against Fed-Ex Corporate Services Inc., Federal Express, doing business as Fed-Ex, Ground Package System Inc., doing business as Fed-Ex Ground, Mreic Sauget IL, LLC and others, alleging negligence.

According to his complaint, Gardner was employed by MW Trucking and drove to a warehouse in Sauget on Oct. 31, 2018. He claims that Fed-Ex employees at the warehouse loaded boxes onto his truck. Gardner alleges that while exiting his truck at the warehouse, he tripped and fell over boxes "scattered throughout the area." The boxes were located behind his truck and near the conveyer belt. 

Gardner claims he suffered injuries to his right ankle, back and body. 

He alleges the boxes were "scattered haphazardly" over the area instead of being placed "in an orderly fashion" onto his truck. 

Gardner claims the defendants failed to warn him of the hazard, failed to have enough employees to stack the boxes that were coming off the conveyor belt, failed to train employees and failed to enforce safety measures. 

Gardner seeks monetary relief of more than $50,000, trial by jury and all other just relief. He is represented by Benjamin Tobin of Pratt & Tobin PC in East Alton.
