Suit alleges Wal-Mart employee dropped metal sign on child, caused concussion

EDWARDSVILLE — A Wal-Mart shopper claims an employee dropped a metal sign on her child's head during repair work. 

Rosetta Freeman, individually and as next-of-kin to Myah Taylor, a minor, and Myah Taylor filed a complaint Oct. 13 in the Madison County Circuit Court against Wal-Mart Stores Inc., and an unknown John Doe, alleging negligence. 

According to the complaint, the plaintiffs were at the Wal-Mart located on Junction Drive in Glen Carbon on Aug. 30, 2019. Freeman claims employee Doe dropped a metal sign off of a shelf while doing repair work, which allegedly hit Taylor in the head. As a result, Freeman alleges Taylor suffered head injuries that include a concussion, headaches and "vision issues." 

The suit states that Taylor suffered pain, mental anguish, disfigurement and "loss of normal life." Freeman also claims she incurred medical expenses. 

The plaintiffs claim Wal-Mart and Doe were negligent for conducting the repair work in the store "when it was not safe to do so" and while customers were in the store. They also claim Wal-Mart failed to properly maintain the premises and the defendants failed to "properly secure the equipment and the metal sign during the repair. 

The plaintiffs seek compensation between $50,000 and $75,000, and all other just relief. They are represented by Michael Glisson and Taylor Fehrenz of Williamson, Webster, Falb & Glisson in Alton.
