Woman alleges dealership sold her defective car, refused to pay for inspection

BELLEVILLE — A woman claims a car dealership illegally retained possession of her vehicle after the dealership that sold the defective car to her refused to pay for the necessary inspection. 

Victoria Gordon filed a complaint  Oct. 1 in the St. Clair County Circuit Court against Bond Auto Brokers LLC and Auffenberg Hyundai Inc., alleging violation of the Illinois Consumer Fraud Act and conversion. 

According to the complaint, Gordon purchased a 2012 Hyundai Veloster with 150,000 miles on it from Bond Auto Brokers for $8,364 on July 24. She alleges she paid $4,000 down on the vehicle and financed the remaining $4,364. Gordon claims that the Hyundai "began to break down" less than three weeks after her purchase, including needing a new transmission. 

Gordon also claims that after having the car towed to Affenberg Hyundai on Aug. 4, an inspection showed the car had "no crank signal from the sensor" and had internal transmission failure. Additionally, she claims the inspection showed the vehicle's "play between gears" was not "engaged correctly." 

Gordon claims Auffenberg sent a $129.95 inspection invoice to Bond Auto, which they refused to pay. Gordon claims that because Bond Auto refused to pay, Affenberg unlawfully retained possession of her car. 

Gordon seeks compensation of more than $100,000 and all other just relief. She is represented by David Duree of David M. Duree & Associates PC in O'Fallon.
