Suit alleges Roundup caused bladder cancer, Non-Hodgkins Lymphoma

Federal Court

A woman claims she developed bladder cancer and her husband developed Non-Hodgkins Lymphoma as a result of exposure to Roundup weed killer.

Dorothy Pawlak, as executor of the estate of Robert Pawlak, filed the complaint Sept. 11 in the U.S. District Court for the Southern District of Illinois against Bayer AG.

According to the complaint, Robert Pawlak used Roundup, a product manufactured by the Monsanto Corporation, for several years prior to his death on Jan. 14. He contracted Non-Hdogkins Lymphoma in 2015 as a result of long term exposure to Roundup, the suit states.

As a result, Dorothy Pawlak and the decedent’s daughter Kimberly Dodge, claim they have suffered a loss of society and the companionship of Robert Pawlak.

Additionally, Dorothy Pawlak claims she was exposed to Roundup, “although she was unaware of the exposure to this product as the product was bought by her late husband, Robert Pawlak.” Dorothy Pawlak was diagnosed with bladder cancer in 2017. She claims she learned that Roundup caused her bladder cancer this year.

As a result, Dorothy Pawlak claims she suffered severe pain, disability and loss of a normal life. She also claims she has incurred medical expenses for treatment.

The plaintiff claims Roundup was unreasonably dangerous and defective.

In 2018, Monsanto was acquired by Bayer AG of Germany.

The plaintiff seeks a judgment in her favor of more than $1.5 million for wrongful death, $1 million for survival action and $1 million for Dorothy Pawlak’s injury claim, plus court costs.

She is represented by Ronald Roth of Roth Law Offices LLC in Granite City.
