A vacuum environmental tech alleges he was wrongfully terminated due to his cardiac disabilities.
Marion Page filed the complaint on Sept. 11 in the U.S. District Court for the Southern District of Illinois against Hydrochem LLC, doing business as Hydrochem PSC 563.
According to the complaint, Hydrochem operates a business on Park Avenue in Granite City with 15 or more employees for each working day in each of 20 or more calendar years. Page claims he was hired as a vacuum environmental tech on Feb. 15, 2018. In June 2018, Page was terminated from his job.
Page claims he had a medical history including coronary artery disease, myocardial infarction with stents, irregular heartbeat with bradycardia, diabetes mellitus, high cholesterol and hypertension. Despite his medical conditions, he claims he was able to perform all of the essential elements of his job without needing any accommodation.
Page also alleges his job performance met or exceeded Hydrochem’s reasonable expectations.
Page claims he “had a past history of a physical impairment that substantially limited Plaintiff’s major life activities and the Defendant regarded the Plaintiff as having a physical impairment.”
The plaintiff claims he was discharged from his position because of a history of disability and perceived disability.
As a result, Page alleges he suffered lost wages, inconvenience, embarrassment and mental anguish.
Page seeks to be reinstated to his job and awarded back pay. He also seeks attorneys fees, litigation expenses and costs.
