Man sues Collinsville property owner after falling into 'hole'

EDWARDSVILLE — A man who was assisting with yard work at a Collinsville property is suing the homeowner after he allegedly stepped into a hole and fell. 

Michael Leroy filed a complaint Sept. 4 in the Madison County Circuit Court against Judy Thiel, alleging negligence. 

In his complaint, Leroy claims that on Sept. 17, 2018, he was helping Thiel with yard work at her home in Collinsville. He alleges that while on her property, he stepped into a "large hole or depression" in her yard that had been covered with debris and leaves. He claims he fell into the hole and suffered "permanent" injuries to his left ankle, left knee and other parts of his body.

Leroy also alleges that as a result of his injuries, he has suffered pain, lost wages and has missed work. He has also incurred medical and hospital bills for treatment of his injuries. 

He claims Thiel breached her "legal duties" by failing to keep her yard clean of debris and leaves and failing to warn him of the "dangerous condition" that existed in her yard. Leroy also claims Thiel knew or should have known that the condition in her yard existed and that she failed to use reasonable care in the maintenance and upkeep of her property. 

Leroy seeks monetary relief of more than $50,000 and all other just relief. He is represented by Matthew Kelly of Schrempf, Kelly & Napp LTD n Alton.
