BELLEVILLE — A former phlebotomist with St. Elizabeth's Hospital claims she did not receive breaks during the day, but they were still deducted from her pay.
Joanna Clark filed a complaint Sept. 1 in the St. Clair County Circuit COurt against St. Elizabeth's Hospital of the Hospital Sisters of the Third Order of St. Francis, alleging violation of the Illinois Wage Payment Collection Act.
Clark states in her complaint that she began working for St. Elizabeth's on Oct. 29, 2012, and received a promotion to lead phlebotomist on Jan. 10, 2018. She claims she worked in that position until her termination on Feb. 14 of this year. She alleges that St. Elizabeth's deducted a 30-minute "lunch break" from her paycheck for each shift , however she claims she worked "straight through" her shifts without getting a 30 minute lunch break or her 15-minute paid break.
Clark also alleges St. Elizabeth's promised 7.8 hours "of paid time off for every 100 hours worked" which she did not receive, despite working on Christmas and New Years.
She claims St. Elizabeth's failure to provide her with a 15-minute break and a 30-minute lunch break along with its failure to give her paid time off is in violation of Illinois law.
Clark seeks monetary relief of more than $50,000 and all other just relief. She is represented by John Leskera of The Leskera Law Firm in Collinsville.
