Shopper sues over slip, fall at Carbondale Kohl's

Lawsuits

BELLEVILLE — A man is suing Kohl's after he allegedly slipped and fell in the Carbondale store's restroom. 

Christopher Burton filed a complaint Aug. 25 in the St. Clair County Circuit Court against Kohl's Inc., and Kohl's Illinois Inc., alleging negligence and premises liability. 

According to his complaint, Burton was at the Kohl's store located on North Giant City Road in Carbondale on Sept. 14, 2018. He alleges that he slipped and fell on "the wet floor" in the restroom. 

Burton claims he suffered "serious injury" and that due to those alleged injuries, he is "hindered and prevented from attending to his usual and customary affairs and duties." 

He also claims he has suffered "a great deal" of pain and anguish both physically and mentally and has become liable for "large sums" due to medical treatment. 

Burton alleges Kohl's was negligent for failing to inspect its restroom "in adequate time," failing to install "anti-slip mats" or other slip prevention devices, and failing to "exercise ordinary care" in maintaining the restroom. 

He also alleges Kohl's should not have allowed customers to use the restroom facilities when they knew it posed a hazard.

Burton seeks monetary relief of more than $50,000 and all other just relief. He is represented by Anthony Gilbreth of St. Clair, Gilbreth & Steppig LLC in Columbia.
