Tenant alleges brain injuries from two icy slip and falls at Shiloh apartment complex

BELLEVILLE  — A tenant at a Shiloh apartment complex claims she suffered severe brain injuries after falling on ice twice in February. 

Irma Cummins filed a complaint Aug. 10 in the St. Clair County Circuit Court against Greenmount Retail Center LLC, alleging negligence. 

According to her complaint, Cummins claims she was a resident at a multifamily apartment complex at Hartman Lakes in Shiloh, which is owned by the defendants. She alleges that on Feb. 6, she slipped on ice that had either melted and refroze or accumulated, which caused her to fall to the ground. She also claims that the following day on Feb. 7, she slipped again on ice but in a different location. She slipped the second time while walking from her apartment to her car, which caused her to hit the ground. 

Cummins claims she suffered "severe" injuries to her brain that led to a "right frontal subarachnoid hemorrhage." She also claims that in addition to her pain and suffering, she has incurred medical bills as a result of the falls. 

Cummins claims Greenmount is negligent for failing to keep the premises safe and failing to inspect the area for ice and treat it with salt. She also alleges Greenmount failed to warn of the dangerous condition and failed to use "reasonable care" to protect her and others from slipping on the accumulated ice. 

Cummins seeks monetary relief of more than $50,000 and all other proper relief. She is represented by Amanda Hayden of The Hayden Law Firm in Clayton, Mo., and Gary Burger of Burger Law in St. Louis.
