Mail carrier sues Edwardsville homeowners after allegedly falling off porch

EDWARDSVILLE — A mail carrier is suing Edwardsville homeowners after she allegedly fell off their porch and suffered injuries during a mail delivery.  

Ann Clayton filed a complaint Aug. 12 in the Madison County Circuit Court against Bryan and Carrie Andreas and CS Gems, alleging negligence. 

According to the complaint, Clayton alleges that on Aug. 17, 2018, she was delivering mail to the Andreas home in Edwardsville. She claims that when she walked onto the porch she fell because the porch was "broken." 

Clayton alleges she suffered a fractured wrist, injury to her ankle, shoulder, lumbar area, muscles, ligaments, tendons and nerves. She also alleges she has incurred medical expenses, endured pain and suffering and lost wages due to her "impairments." 

Clayton claims the defendants failed to inspect and maintain their premises to prevent "dangerous conditions" and that "upon reasonable inspection," they would have noticed the alleged defect of their porch. She also claims the defendants failed "to exercise due care" regarding the safety of their porch and walkway to notify visitors of the dangerous condition. 

Clayton seeks monetary relief of more than $50,000 and all other just relief. She is represented by Kirk Caponi of Williams, Caponi & Associates PC in Belleville.
