Granite City homeowners sue sanitary district over sewage backup in their home

EDWARDSVILLE - Granite City homeowners claims the negligence of a Madison County sanitary district caused sewage to back up into their home. 

Elaine Roustio and Randy Roustio filed a complaint Aug. 12 in the Madison County Circuit Court against Madison County Special Service Area #1, (SSA) a body politic, alleging negligence. 

According to the complaint, the Roustios own property located on Snowbird Lane in Granite City where the SSA operates, manages and maintains the storm water sewer and sanitation system for the city.  They allege in their complaint that on Aug. 12, 2019, the area where their property is located experienced "large amounts of rainfall throughout the day and night." They claim that the storm water and raw sewage from the city's system backed-up into their home. 

The Roustios allege that the sewage backup caused "extensive damage" to their property, causing them to incur costs as well as "sickness and mental distress." 

They also allege their property has "suffered permanent damage and destruction," which has affected its sentimental value and real property value. 

The Roustios claim in their suit that the SSA failed to "properly operate" the sewage pump systems or properly maintain, inspect and repair the system. They also claim the SSA failed to "carry-off" and dispose of the sewage and allowed it to "crossover between sewage and stormwater." 

The Roustios seek monetary relief of more than $50,000 and all other just relief. They are represented by Daniel Seidman of Seidman Margulis & Fairman LLP Belleville.
