Suit alleges customer slipped on grease spot at Shiloh Freddy's restaurant

BELLEVILLE — A woman claims she slipped on a grease spot and sustained injuries at the Shiloh Freddy's Frozen Custard and Steakburgers restaurant. 

Tracy Niznik filed a complaint July 23 in the St. Clair County Circuit Court against Freddy's Frozen Custard and Steakburgers LLC and Jacob Stone, alleging negligence. 

According to her complaint, Niznik was at Freddy's Frozen Custard and Steakburgers in Shiloh on July 26, 2018. She claims she stepped on "a wet greasy spot" that was on the floor and that the only warning of the hazard was a "small negligently placed sign" that she could not see prior to her alleged fall. 

As a result, Niznik claims she suffered a fracture to her right patella, suffered pain as well as loss of income. She also claims she has incurred approximately $5,000 in medical expenses due to her injuries. 

Niznik alleges the defendant negligently failed to keep their premises safe for customers, failed to "promptly" clean the spill and failed to have a "visible sign" to warn customers of the hazard. 

Niznik also claims Stone was a manager at Freddy's at the time of the alleged incident and had a "duty to use ordinary care" for the plaintiff's safety as well as the safety of all the customers on their premises. 

Niznik seeks monetary relief of more than $50,000 and all other proper relief. She is represented by Richard Dowd and William Dowd of Dowd & Dowd PC in St. Louis.
