Wheelchair-bound woman sues medical car service driver

EDWARDSVILLE — A woman in a wheelchair who was being transported by a medical car service company claims reckless driving caused her to hit the dashboard and suffer injuries. 

Christina Nance filed a complaint July 29 in the Madison County Circuit Court against Dickie Smith, Richard Smith, Ricky Smith and Helping Hands Medical Service Car, Inc., alleging negligence. 

According to the complaint, Nance was in a wheelchair due to a foot injury. She was a passenger in one of Helping Hands' vehicles known as a "medcab" that was driven by Smith on July 31, 2018. Nance alleges the vehicle was being driven "at a high rate of speed" as it approached an intersection when the driver suddenly hit the breaks and caused her to "forcefully strike" the dashboard of the vehicle. 

Nance claims the defendants failed to "buckle" her in, failed to warn her of the quick stop, and operated the vehicle in a careless and reckless manner. 

Nance claims she suffered injuries to her back and foot and has incurred medical expenses and has endured pain and suffering as a result of her injuries. 

She alleges Smith had a "duty of reasonable and ordinary care" to the passengers in the vehicle.

Nance seeks monetary relief of more than $50,000 and all other just relief. She is represented by Michael Glisson and Timothy Chartrand of Williamson, Webster, Falb & Glisson in Alton.
