Customer accuses mall of negligence over slip and fall

BELLEVILLE - A customer claims she was injured when she slipped and fell at a shopping mall.

Suzanne L. Lobosco, of Freeburg, filed suit July 2 in St. Clair County Circuit Court against CBL Properties, which does business as St. Clair Square Mall in Fairview Heights.

The suit claims that on Dec. 14, 2018, Lobosco was shopping at the mall when the slipped and fell on a puddle of water.

"They allowed water to remain on the mall floor of which they had actual knowledge or constructive knowledge of water being on the floor," the suit alleges.

The defendant was negligent for failing to warn of the water on the floor, and should have known it was present, Lobosco claims.

"As a direct and approximate result of one or more of the foregoing acts and/or omissions on the part of the defendant, the plaintiff, while walking in the mall, slipped on the water and fell causing injuries and damages," the suit states.

Lobosco alleges she has paid out medical bills in the past and will do so in the future. She also suffered pain and loss of normal life, according to the suit.

The plaintiff, who is seeking more than $50,000 in damages, is represented by Jerry F. Costello of Bonifield & Rosenstengel of Belleville.
