Tree trimmer alleges falling limb caused injuries

EDWARDSVILLE - A man trimming trees in Roxana claims he was injured when a limb fell and knocked the chainsaw from his hand. 

Plaintiff Lucas Stark claims he was on the roof of a house in Roxana when a limb being lowered to the ground came loose and struck him.

Stark filed suit June 17 in Madison County Circuit Court against Bill Browers and his tree trimming company, Bill's Tree Service of Ridgedale, Mo.

According to the complaint, Stark was asked by Browers to help him and the business to remove trees and limbs on June 23, 2018. While he and the defendant were cutting branches and limbs with a gas-powered chainsaw, Stark claims he was injured. 

Stark claims he was injured when a rope being used by the defendant to lower limbs to the ground came away from a tree limb stub. This caused a limb to fall and strike the plaintiff, which knocked the chainsaw from his hands and caused 'severe injuries.'

The defendants are accused of failing to adequately secure the roop, cut limbs from above the plaintiff without proper safety precautions, and failed to warn.

Stark alleges he suffered an injury to his left arm, spent money on medical bills, and has lost income.

The plaintiff, who is seeking more than $50,000 in damages, is represented by Samuel A. Mormino of MVS Lawyers in Alton.
