BELLEVILLE - A man alleges his neighbor's dog attacked him as he stood outside his home in Belleville.
Alan Marcus, of S 86th Street, has filed suit against his neighbor and a landlord, alleging violations of the Animal Control Act and negligence.
Marcus filed suit June 4 in St. Clair County Circuit Court against Calvert Gamble and B & T Building Concepts.
According to the complaint, Marcus claims he was standing outside his home around 1:49 p.m. on May 23, conducting himself peacefully. At the same time, Gamble's dog was allegedly unrestrained.
"Without any provocation, the dog that Defendant owned and/or had a right of property in, sought out, and attacked Plaintiff, injuring his person," the suit states.
Marcus claims Gamble "allowed the dog to roam the premises, endangering the safety" of all in the area.
"Plaintiff has endured pain and suffering and will continue to endure pain and suffering in the future; plaintiff has suffered and will in the future suffer disability and disfigurement; and plaintiff has incurred and will in the future incur medical expenses as a result of the injuries sustained by defendant's dog," the suit states.
Gamble is accused of negligence for allegedly failing to monitor the dog's "unmanageable behavior" and knew, or should have known, the animal to be "vicious."
The owner of the property, B & T Building Concepts, is accused of negligence because it allegedly "knew Calvert Gamble housed a mischievous, vicious, dangerous dog on said property."
Marcus, who is seeking more than $50,000 in damages, is represented by John Hipskind of Hispskind & McAninch of Belleville.
