FedEx employee sues over alleged sexual harassment, hostile work environment

State Court

EDWARDSVILLE — A former female FedEx employee claims she suffered sexual harassment from male supervisors and co-workers.

Wendy Brooks filed a complaint May 19 in Madison County Circuit Court against FedEx Supply Chain Inc., alleging violation of Title VII of the Civil Rights Act.

According to the complaint, Brooks claims she was subjected to sexual harassment and a hostile work environment from her male supervisors and male co-workers while working for FedEx. Brooks alleges she complained of the harassment and hostile work environment to her managers, but the conduct continued. The plaintiff further claims the situation resulted in her employer taking adverse employment actions against her.

“FedEx failed to take reasonable steps in discovering, preventing and remedying the sexual harassment and hostile work environment,” the suit states.

The plaintiff claims male co-workers who were similarly situated were treated more favorably at work.

“Brooks was qualified for her position and was able to perform essential functions of her job, meeting her employer’s legitimate work expectations,” the suit states.

As a result of the harassment and hostile work environment, Brooks claims she has endured emotional distress, mental anguish, pain and suffering, inconvenience, loss of enjoyment of life, and other losses.

Brooks seeks monetary relief of more than $50,000, plus interest and all other proper relief.

“In addition, FedEx, through its managers, had knowledge that it may have been acting in violation of federal law and/or FedEx approved or ratified the acts of sexual harassment and hostile work environment and thus, Brooks is entitled to punitive damages,” the suit states.

She is represented by Michael Brunton and Mary Stewart of The Bruton Law Office PC in Collinsville.
