Man alleges negligent knee surgery led to permanent need for walking device

Lawsuits

EDWARDSVILLE — A man is suing OSF Health St. Anthony's Health Center and its physician alleging their negligent care led to his knee infection and permanent need for a walking device.

Anthony Miller filed a complaint May 20 in Madison County Circuit Court against Dr. Randall Rogalsky, MD, Alton Multispecialists LTD and OSF Health St. Anthony's Health Center, alleging negligence.

According to the complaint, Miller claims he received treatment from Rogalsky on May 18, 2018 and on July 18, 2018. He claims the surgery performed on his knee at St. Anthony’s Health Center was done carelessly, causing him to get an infection.

Miller claims he now must use a walking device due to the alleged negligent care.

Miller alleges Rogalsky deviated from the standard of care customarily used in the practice of orthopedic medicine.

The defendant is accused of negligently and carelessly performing a knee surgery, failing to inform the plaintiff of the infection, failing to treat the infection, discharging the patient before determining the extent of the infection to his knee, and rendering the plaintiff dependent on some form of assisted walking device for the rest of his life.

As a result, the plaintiff claims he sustained significant injuries and suffered pain and mental anguish.

Miller seeks monetary relief of more than $50,000 and all other just relief. He is represented by Attorney Mark Peebles of Belleville.
