Man sues cosmetic surgery center over trip, fall in entryway

EDWARDSVILLE - A cosmetic surgery center is being sued over claims its entryway was uneven and dangerous. 

Ronald Chiarattino filed suit in Madison County Circuit Court against Midamerica Institure of Plastic and Cosmetic Surgery, alleging he tripped and fell as he entered the Glen Carbon premises on March 29, 2019.

Chiarattino claims the company, and other named defendants, including Hurford Architects, owed a duty of care that allows safe entry into the building.

He also claims they should have warned visitors that the entrance patio had an uneven grade, creating a dangerous condition. 

The defendants are accused of failing to warn visitors that there was an uneven grade, failed to paint the surface so that this would be revealed, and failed to comply with regulations requiring them to provide a walkway free from trip hazards.

According to the suit, Chiarattino sustained injuries to his face, head, neck, and related areas when he fell. He claims he suffered pain and mental anguish, lost income, and incurred medical bills, according to the suit.

The plaintiff, who is seeking more than $50,000 in damages, is represented by Brian M. Wendler of the Wendler Law Firm in Edwardsville.
