Super Bowl party host sues after he's injured by guest's alleged negligent operation of drone

A Super Bowl party ended on a sour note after an errant drone caused an injury.

Now, a partygoer is facing a lawsuit in the Circuit Court for the Twentieth Judicial Circuit in St. Clair County.

Filed last month, party host Robert Mize alleges guest John S. Mize navigated a drone inside his home in Millstadt during halftime, in the Philadelphia Eagles match against the New England Patriots which ended with a 41-33 Eagles win. 

According to the complaint, John Mize's negligent operation of the drone caused injury to Robert Mize.

“Defendant negligently controlled his drone near plaintiff, during halftime of the Super Bowl, with the direct and proximate result that defendant’s drone struck plaintiff in the face and upper body," the suit says. "Defendant knew or should have known that flying the drone so close to plaintiff could reasonably lead to injury.”

More specifically, Robert said John failed to control his drone properly, and didn’t keep it a safe distance away from the plaintiff. Robert claims that because of John’s actions, or lack thereof, he suffered major injuries, has missed days at work, and subsequently lost income because of the incident. He added that his earning capacity has been negatively impacted, and he has also had to cover medical expenses.

Robert Mize is seeking at least $50,000 along with the costs of filing the lawsuit and is represented by Benedict Y. Song of Chatham & Baricevic law firm in Belleville.

Song did not respond to request for a comment.
