Edwardsville man sues over collision with cart

An Edwardsville man is claiming he was seriously injured after being knocked down by a delivery cart outside a movie theater.

Edward Giese has filed suit in Madison County Circuit Court against a distribution company that employed a delivery man pushing the cart.

He is suing Donnewald Distributing, which is headquartered in Greenville, for alleged negligence. Donnewald Distributing did not immediately return a call from the Record requesting comment.

The suit notes that Donnewald Distributing delivers products to various parts of the state and beyond, including the AMC Show Place Twelve Cinema in Edwardsville.

As the delivery person approached from the left, the plaintiff was struck by the cart, the complaint states.

It alleges the delivery man failed to keep a proper look out for pedestrians on the sidewalk, and "did not navigate his cart in a way to avoid striking plaintiff."

"As a result of said collision, plaintiff suffered serious injuries to his neck, back and shoulder, which necessitated additional surgery," according to the complaint.

It continues, "Plaintiff suffered pain and will continue to suffer pain as a result of these injuries, has suffered and will continue to suffer disability....has incurred, and will continue to incur, medical expenses as a result of these injuries."

Giese is seeking in excess of $50,000 in damages. He is represented by Ronald A. Roth of Granite City.
