Man voluntarily dismisses suit two years after alleging ex-wife recorded private conversations

A man who accused his ex-wife of recording private phone calls with his minor son and posting them to Facebook voluntarily dismissed the case after it pended for two years with no action.

Plaintiff Chad Beintker filed a motion to dismiss without prejudice on Feb. 26.

St. Clair County Circuit Judge Chris Kolker granted the motion to dismiss on Feb. 28 and ordered the clerk to close the case.

The docket showed that no action had been done in litigating the case since the complaint was filed Feb. 28, 2017.

Beintker filed the complaint against his ex-wife, Trissa Jenkins, alleging violations of the Illinois Eavesdrop Act.

According to the complaint, Beintker alleged that beginning in February 2015, his private telephone visitation calls with his minor son were recorded and posted on Facebook without his consent.

As a result, Beintker claimed he suffered emotional trauma.

He alleged Jenkins invaded his privacy and deliberately exposed him.

He sought compensatory damages in excess of $50,000, plus court costs and all other relief deemed just and proper.

At the time the case was filed, he was represented by Eric M. Rhein in Belleville.
