St. Clair County circuit judge Chris Kolker dismissed a property owner in a woman’s suit alleging she was forced to walk on an injured ankle by Fairview Heights police officers.
On March 6, plaintiff Athira Mohd Nor filed a stipulation to dismiss defendant SMA LLC with prejudice and without cost to any party.
Kolker granted dismissal on March 19.
Mohd Nor filed her complaint on March 28 against SMA, Richard Roe and John Doe.
According to the complaint, the plaintiff alleges that on March 24, 2017, she was lawfully on SMA’s premises when she slipped and fell in the parking lot, injuring her ankle.
Shortly after her fall, Mohd Nor claims she was a passenger in a vehicle with her ex-boyfriend when he was pulled over at the O’Fallon Taco Bell and arrested for various offenses.
Although Mohd Nor was not charged with a crime, she claims she was also taken to the police station. She alleges she was ordered to walk on her injured ankle until she could no longer support her weight.
Mohd Nor alleges she was forced to walk on her ankle despite her complaints and alleges the police officers failed to timely provide medical treatment. She also alleges SMA breached its duty to maintain the premises in a reasonably safe condition.
She claims she ultimately suffered a fractured ankle.
The plaintiff seeks a judgment of more than $50,000, plus costs and any other relief the court deems just.
