Jack Schmitt Chevrolet denies liability in suit alleging tires fell off bus

A Wood River car dealership alleges a woman caused or contributed to her own injuries in a suit alleging she was injured as a passenger when tires fell off a bus.

Denise Montgomery filed her complaint May 8 against Jack Schmitt Chevrolet of Wood River Inc.

In her complaint, Montgomery claims she was a passenger in a bus maintained by the defendant on June 12, 2016, when the vehicle’s rear tires fell off on Edison Avenue in Granite City.

The plaintiff claims she suffered serious and permanent injuries to her head, back, neck and shoulders. She also claims she incurred medical expenses.

Montgomery alleges the defendant failed to perform repair work in a good and workmanlike manner.

The defendant answered the complaint on June 15 through attorney Paul Rausehenbach of the Law Office of Craig A. Hansen in St. Louis.

Jack Schmitt Chevrolet denies liability and argues in its affirmative defenses that the acts or omissions of third parties caused or contributed to the alleged damages.

The defendant further argues that the plaintiff caused or contributed to her own injuries

Montgomery seeks a judgment of more than $50,000, plus costs.

She is represented by Thomas G. Wilmowski Jr. of Schultz & Myers LLC in St. Louis.
