EDWARDSVILLE – A title insurance company alleges two Madison County residents owe more than $90,000.
Commonwealth Land Title Insurance Co. filed a complaint on Feb. 16 in the Madison County Circuit Court against James Eberhart and Roberta Eberhart, alleging unjust enrichment.
According to the complaint, the plaintiff alleges the defendants have failed to pay an insured lender the amount due and owing on a note.
Commonwealth Land Title Insurance alleges its payment of $93,860.34 to the lender constitutes a credit to the amounts due and owing by the defendant to the lender pursuant to the note.
The plaintiff claims that the defendants have been relieved of their duty to pay the amount to the lender and have therefore been unjustly enriched.
The plaintiff seeks judgment for the amount of $93,860.34 plus costs and any and all other relief the court deems fair and just.
