Landlord alleges Allstate denied claim

Insurance 05

BELLEVILLE — A property landlord is suing an insurance company for denying his claim following a fire.

Tremell Norman filed a complaint on Nov. 8 in the St. Clair County Circuit Court against Allstate Indemnity Company, alleging breach of contract.

According to the complaint, the plaintiff alleges that on March 15, he duly notified Allstate of the fire losses that happened to his property and has kept and performed all terms and conditions of the policy. However, he claims his insurance claim was denied.

As a result, Norman claims he incurred out of pocket expenses amounting to $300,572.05 and owed money for lost rent in connection with the destroyed building.

The plaintiff alleges Allstate failed and refused to pay for the insured's losses under the insurance policy without good cause or excuse and failed to consider insured's interest in the matter as equal to its own interest as the insurer.

The plaintiff requests a trial by jury and seeks judgment in the amount of $299,305.72, including statutory penalty of $60,0000, plus attorney's fees, interest, lost rents, and costs incurred.

He is represented by Mark M. Silvermintz of Law Office of Mark M. Silvermintz in Collinsville.
