BELLEVILLE – A man alleges he was injured in a rear-end collision in O'Fallon with a Bimbo Bakery employee.
Randall Ratliff filed a complaint on Nov. 6 in the St. Clair County Circuit Court against Ian Muelle and BBU Inc., also known as Bimbo Bakeries USA, alleging negligence.
According to the complaint, the plaintiff alleges that on July 1, 2016, he was stopped at U.S. Highway 50 in response to traffic ahead when Muelle's Utilimaster truck struck the rear of the plaintiff's Chevrolet pickup, causing the plaintiff's vehicle to strike the rear of another vehicle.
The suit states Muelle was driving and operating the Utilimaster truck owned by the defendant Bimbo Bakeries.
As a result, Ratliff claims he sustained physical injuries, was prevented from engaging in his normal activities and incurred medical expenses.
The plaintiff alleges Muelle failed to apply the brakes, failed to reduce speed of the truck when a special hazard existed with respect to other traffic and failed to keep the truck under proper control.
The plaintiff seeks judgment that is fair and just for the damages sustained, plus costs of suit.
He is represented by Sam C. Mitchell of Sam C. Mitchell & Associates in West Frankfort.
