EDWARDSVILLE — A Granite City car owner claims a Bommarito Audi West County employee crashed his car while it was at the dealership for trim repairs.

Daniel M. Kaltmayer filed a complaint on Nov. 3 in the Madison County Circuit Court against Frank Bommarito Buick GMC, Inc., doing business as Bommarito Audi West County, alleging it failed to provide reasonable care in the repair of the vehicle.

According to the complaint, the plaintiff alleges that on March 7, he took his Audi to the defendant's service department for a repair on the trim holding but was notified the next day that his Audi was involved in an accident wherein an employee attempted to a pass a trash truck and suffered a collision.

The plaintiff alleges the defendant drove the Audi for purposes other than repairing the trim holding and deprived vehicle owner of the use of his personal property.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000 for punitive damages, and for any other relief the court deems just and equitable.

He is represented by Christopher W. Byron of Byron Carlson Petri & Kalb, LLC in Edwardsville.
