Camp Drug Store files class action over allegedly unwanted fax advertisements

BENTON – A Madison County pharmacy alleges a Texas-based wholesale pharmacy supplier sent it unsolicited faxes.

Camp Drug Store Inc., individually and as the representative of a class of those similarly situated, filed a complaint on Oct. 3 in the U.S. District Court for the Southern District of Illinois against Real Value Products Corp., doing business as Hospital Pharmaceutical Consulting, for alleged violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on April 18 it received at least two of the defendant's advertisements by facsimile promoting its pharmaceutical products but claims it did not expressly consent to receive any advertisements and does not have an established business relationship with the defendant. 

The plaintiff alleges the defendant made unsolicited advertisements without express invitation or permission and improperly and unlawfully converted the classes' fax machines to its own use.

The plaintiff seeks an award of damages, punitive damages, attorney's fees, costs of suit, such further relief as it may deem just and proper.
