Patient accuses Belleville physician of touching her inappropriately

BELLEVILLE – A patient alleges that a Belleville doctor touched her in an inappropriate manner during a hemorrhoid banding procedure.

Kelly Titsworth and Timothy Titsworth filed a complaint on Oct. 26 in the St. Clair County Circuit Court against Levi Kirkland, M.D. and Levi Kirkland, M.D. LLC, et al. alleging battery, professional negligence and other counts.

According to the complaint, the plaintiffs allege that on Oct. 27, 2015, Kelly Titsworth underwent a hemorrhoid banding procedure by Kirkland. She alleges she was touched in a sexual manner without her permission during the examination. The suit states Kirkland penetrated her vagina with his fingers without informing her he was going to do so.

The plaintiffs alleges Kirkland failed to inform Kelly Titsworth that a hemorrhoid banding procedure might require digital penetration of the vagina. She alleges that had she had known this, she would have elected not to have the procedure done by the defendant.

The plaintiffs request a trial by jury and seek judgment for damages suffered for an amount to exceed $50,000 together with costs and any further relief deemed just. They are represented by Jonathan T. Nessler of Nessler & Associates LTD in Springfield.
