Woman claims she suffered food poisoning after eating potatoes at China Express

BELLEVILLE – A patron of a Cahokia restaurant alleges she contracted food poisoning from eating rotten potatoes.

Eve Pitts filed a complaint on Oct. 11 in the St. Clair County Circuit Court against Lam Danh, doing business as China Express, alleging negligence.

According to the complaint, Pitts alleges that on July 10, she was an invitee of the defendant and consumed food from the buffet. The plaintiff claims that the potatoes she ate were old, rotten and not fit for consumption, which caused food poisoning. 

The plaintiff alleges the defendant allowed old, rotten potatoes to remain on its buffet, failed to warn of the dangers associated with eating the potatoes on its buffet and failed to exercise reasonable care in the dispensing and serving of its product for public consumption.

The plaintiff seeks judgment in an amount of more than $50,000 plus punitive damages, attorneys' fees, costs of suit, and for any other relief the court deems just and proper.
