Nelson Tree Service Inc., employee named in suit by driver seeking damages for O'Fallon collision

BELLEVILLE – A mother with her minor son are seeking damages after a collision in O'Fallon.

Raekil Adbus-Salaam and minor Maalik Abdus-Salaam filed a complaint on Sept. 15 in the St. Clair County Circuit Court against Timothy Mitchell and Nelson Tree Service Inc. alleging negligence.

According to the complaint, on April 15, 2016, Raekil Abdus Salaam was driving her motor vehicle with Maalik Abdus-Salaam as passenger on Milburn School Road when their vehicle was struck by defendant Mitchell when he entered their lane of traffic. The suit states Mitchell was in the course of his employment with defendant Nelson Tree Service during the collision. 

As a result, plaintiffs allege they suffered physical injuries and incurred hospital bills. 

The plaintiffs hold the defendants responsible because defendant Mitchell allegedly failed to keep a proper lookout for other vehicles, failed to properly apply brakes and drove the vehicle at an excessive rate of speed.

The plaintiffs seek judgment in a sum of money not to exceed $60,000 to compensate for damages sustained, plus costs of suit. They are represented by John M. Hustava of John Hustava Attorney at Law in Collinsville.
