A security system company says a treatment room at a Godfrey spa was an office when the video surveillance system was installed and denies liability in a woman’s suit alleging she was recorded while undressing to receive a facial.
Colleen Overstreet filed the complaint on Sept. 8 against Miroslawa Inc., doing business as Dutch Hollow Medical Day Spa, Miroslawn Figueroa, Samuel Figueroa and Ronald Riddlespriger, doing business as High Tech Security Systems Inc.
In her complaint, Overstreet alleges she visited Dutch Hollow Medical Day Spa on Sept. 17, 2015, to receive a facial at its Godfrey facility. She claims that without her authorization or knowledge, she was video surveilled or videotaped while dressing and undressing in the room in which she received the spa treatment.
Overstreet alleges the defendants allowed the video surveillance to be viewed or published by unknown parties and failed to protect the customer’s personal privacy.
Riddlespriger answered the complaint on Oct. 25.
The defendant denies liability and demands strict proof of the allegations. He argues that “at the time of the installation the room in question was the office of Miraslava Figuero, and not a treatment room.”
Overstreet seeks a judgment of more than $50,000, plus court costs.
