Owner of Collinsville condo claims association, others didn't disclose drainage issue

EDWARDSVILLE — A property buyer is suing a Collinsville condominium association and others for allegedly failing to inform the buyer that the property had a drainage and flooding problem. 

Raymond J. Muniz filed a complaint Oct. 18 in the Madison County Circuit Court against Knightsbridge Villas Condominium Association, Laura A. Clark, Paula J. Wanous and Epic Realty LLC for alleged violation of the Consumer Fraud Act, breach of implied warranty and unjust enrichment.

According to the complaint, Muniz alleges he purchased the defendant's property for $206,000 but claims he was not informed of a drainage and flooding problem. He claims the problem occurred Aug. 9, 2015, which caused extensive damage to the basement walls, baseboards, carpet and padding, furniture and a computer. 

As a result, Muniz claims he spent countless hours cleaning, disinfecting and restoring the property, which took a considerable amount time and expenses to fix the damage to the condominium. 

The plaintiff alleges the defendants failed to investigate the root cause of the drainage and flooding problem, failed to disclose the draining and flooding problem to the buyer and failed to help owners investigate and resolve the drainage and flooding problem.

The plaintiff seeks judgment in an amount in excess of $50,000 together with attorney's fees, costs of suit as recoverable under the Consumer Fraud Act.
