Bank claims Edwardsville homeowner defaulted on promissory note

Contract 07

EDWARDSVILLE — A bank is suing an individual, citing alleged breach of contract.

Regions Bank filed a complaint Oct. 16 in the Madison County Circuit Court against Winston Wallace for alleged violation of the contract for a home equity line of credit.

According to the complaint, the plaintiff alleges that on June 14, 2006, Wallace executed a promissory note for a home equity line of credit for $199,000 plus interest and other costs pursuant to the contract. The plaintiff claims the Edwardsville property was foreclosed and the defendant owes the balance due on the note.

The plaintiff holds Wallace responsible because the defendant allegedly defaulted on the payments, that resulted in foreclosure of the property, and has a balance of $194,613.28 remaining.

The plaintiff seeks judgment of $194,613.28 plus costs of action, without relief proper in the premises. The plaintiff is represented by Bleecker, Brodey & Andrews in Indianapolis.
