EDWARDSVILLE — Granite City claims its sewer system began cracking and corroding shortly after repairs were completed.
The City of Granite City filed a complaint on Oct. 5 in the Madison County Circuit Court against Instituform Technologies USA. Inc., Mechanical Jobbers Marketing, Inc., Protective Liner Systems, Inc., and Travelers Casualty and Surety Company of America, alleging breach of warranty.
According to the complaint, the plaintiff alleges that on Nov. 4, 2011, the city entered into a contractual agreement with the defendants to repair the sewer system. Granite City claims that after completing the project, the liners began to show cracks and defects due to improper installation and material defects.
As a result, Granite City claims it has suffered damages through the corrosion of the sewer stations and will be forced to re-line its stations at considerable costs to the city.
The plaintiff allege the defendants failed to repair or replace the defective sewer line system, failed to prevent further corrosion that were found to have manufacturing defects and failed to comply with the agreed express five-year warranty.
The plaintiff requests a trial by jury and seeks judgment in excess of $50,000 to compensate for the damages, plus any other relief the court deems appropriate.
