EDWARDSVILLE – A Macoupin County driver alleges he was injured in an accident on an Interstate 255 off-ramp.
Charles W. Kurtzeborn filed a complaint on Oct. 3 in the Madison County Circuit Court against Mark J. Hofferber and John Doe, employer, alleging negligence.
According to the complaint, Kurtzeborn alleges that on Oct. 5, 2015, while driving on the off-ramp of Interstate 255 southbound merging onto state Route 111 by the use of the right turn lane, his vehicle was struck in the rear by the defendants' vehicle. As a result, Kurtzeborn claims he suffered physical injuries and medical expenses.
The plaintiff holds Hofferber and Doe responsible because Hofferber allegedly failed to keep and maintain a constant, careful and vigilant lookout for other vehicles and persons on the roadway; failed to reduce speed; and failed to keep the vehicle under control.
The plaintiff seeks judgment in an amount greater than $50,000 to fairly and adequately compensate for damages sustained, plus costs of suit. He is represented by S. Martin Janksy of Martin Jansky Law Firm PC in St. Louis.
