Woman sues bus company, driver over fatal collision

BELLEVILLE — A woman is suing a bus driver and school bus company for allegedly striking her husband while he walked along the side of Highway 50. 

Dal Magar and Dhan Magar filed a complaint on Sept. 7 in the St. Clair County Circuit Court against Illinois Central School Bus, LLC and Debi Scroggins, alleging the defendants failed to operate the bus with due care and caution.

According to the complaint, the plaintiffs allege that on Sept. 8, 2015, Dal Magar was a pedestrian walking westerly in the grass along Highway 50 when he was struck by an Illinois Central School's bus operated by Scroggins. He died as a result of the collision, the suit states.

Dhan Magar claims she lost the services and society of her husband, lost wages and incurred expenses, the suit states. 

The plaintiffs allege the defendants operated the bus at an excessive and dangerous rate of speed, failed to maintain a proper and sufficient lookout and failed to provide a working passenger camera so that the bus driver would not be distracted.

The plaintiffs request a trial by jury and seek judgment in an amount exceeding $50,000, plus costs and any other relief the court deems proper.
