EDWARDSVILLE – A man employed as a deckhand/tankerman alleges that the hot conditions of a warehouse in Wood River caused him to suffer heat stroke.
Daniel E. Eudy filed a complaint on Sept. 20 in the Madison County Circuit Court against MERS LLC, doing business as Economy Boat Store, alleging that the defendant violated the Jones Act.
According to the complaint, Eudy alleges that on July 31, 2016, he was seriously injured when he became severely dehydrated while performing strenuous physical labor in extremely hot, humid and unventilated conditions in the defendant's warehouse in Wood River.
As a result, Eudy claims he suffered a heat stroke and an ischemic stroke.
The plaintiff alleges the defendant failed to provide a reasonably safe place to work and failed to meet its duty under the General Maritime Law to provide its employees with full and adequate maintenance and cure for injuries incurred.
The plaintiff requests a trial by jury and seeks judgment in an amount of no less than $40 per day, payment of all reasonable medical expenses incurred, legal interest, costs, attorney fees, and all general and equitable relief as the court deems just and proper.
